We may share information about you in connection with (including the during the negotiation of) a corporate change or dissolution, including for example a merger, acquisition, reorganization, consolidation, bankruptcy, liquidation, sale of assets or wind-down of a business (each a "Corporate Transaction"). Unless prohibited by applicable law, we reserve the right to transfer the information we maintain in the event we engage in any Corporate Transaction (including, selling or transferring all or a portion of our business or assets). In addition, we may share your information to comply with legal or regulatory requirements, industry standards, judicial process, and our company policies, as well as to protect against, identify, investigate, prevent and respond to fraud, illegal activity (such as identifying and responding to incidents of hacking or misuse of our websites and mobile applications), adverse event reporting, and claims and other liabilities.

Do Not Track Disclosures

Some web browsers may transmit "do-not-track" signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. Because there currently is no industry standard concerning what, if anything, websites should do when they receive such signals, we currently do not change our tracking practices (which are explained in more detail directly above) in response to "do-not-track" (DNT) settings in your web browser. If and when a final standard is established and accepted, we will reassess how to respond to these signals.

Our third-party partners, such as ad networks, web analytics companies and social media and networking platforms, collect information about your online activities over time and across our Site and other online properties. These third parties may not change their tracking practices in response to DNT settings in your web browser and we do not obligate these parties to honor DNT settings. Social Networking

We maintain a presence on several social networking and blogging platforms, such as Facebook, Instagram, WordPress, Twitter, and Pinterest. We may incorporate some third-party social networking features onto our Site (including, allowing users to interact with others and share certain Site content and information on social media platforms) or utilize third-party provided platforms to publish or manage the Site or portions thereof. Through these platforms and features, we receive or may share information about you, and this Privacy Notice applies to that information as well. In addition, some providers of third-party social networking or blogging platforms we utilize (such as Facebook, Instagram, WordPress, Twitter, and Pinterest) have their own privacy policies which explain how the third parties that provide them may collect, use and protect your information ( e.g., if you establish an account with such platform providers directly). By using the social networking features, you agree to those third parties’ privacy policies and terms of use.

In addition, you may be able to use your Facebook or other social networking platform login to set up an account on the Site. If you wish to use your Facebook or other social media account to log into the Site, your information may be shared with us for the purpose of setting up your account on the Site and as otherwise provided in those platforms’ privacy policies and terms of use.

Mobile Apps

We may make available mobile applications (or "apps") that you are able to download and use from your mobile device. Depending on the nature and functionality of the app, we may collect personal information and non-personally identifiable usage information through the app, any features on your mobile device to which you grant us access. The app also may collect information about your mobile device, such as your ID for Advertisers (IDFA) or Advertising ID, the IP address of your mobile device, device type, operating system and connection information (e.g., Wi-Fi, LTE, 4G, 3G). If you opt-in, some of our apps may collect your device’s precise real-time location, and in such cases, you may be able to opt out from further allowing us to have access to such location data by managing your location preferences in the app and/or on your device. Payment and Third-Party Payment Processors

Purchases made through the Site may be processed through a third-party payment processor, application, or other payment service provider (each, a "Payment Processor"). If applicable, you may be provided a notice when accessing the payment application or entering your payment information directing you to such Payment Processor’s terms of use and privacy policy, and all payments are governed by such terms of use and privacy policy.

Information for Individuals in the European Economic Area and the United Kingdom

Legal basis for processing data

In this section, we identify the legal grounds on which we rely to process personal information.

We comply with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. We have certified to the Department of Commerce that we adhere to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Notice and the Privacy Shield Principles, the Privacy Shield Principles shall take precedence. California’s "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. Payment card information is processed by third-party Payment Processors pursuant to their applicable privacy policies. Return To Shine Bathroom

1. Eligibility: This Campaign is open only to those who sign up at the try.shinebathroom.com and who are at least 18 years old as of the date of entry. The Campaign is open to All legal residents of the United States, and is void where prohibited by law. Employees of GrowthRocks, Viral-loops and Shine Bathroom Technologies Inc., its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Shine Bathroom Technologies Inc. as final and binding as it relates to the content of this Campaign.

3. Campaign Period: Entries will be accepted online starting on 9/24/18, 12:01am and ending 10/02/18, 12:01am. All online entries must be received by 10/02/18, 12:01am.

4. How to Enter: The Campaign must be entered by submitting an entry using the online form provided at try.shinebathroom.com. The entry must fulfill all Campaign requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Shine Bathroom Technologies Inc.. Optional verbiage to include: The system manages double bookings automatically, but in any case you may enter only once. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Shine Bathroom Technologies Inc.. The above applies also in cases that You will try to take advantage of people you refer by using your referral code to promote the contest. It indeed results into getting the referee emails but actually the referees have no chance to win as they will all use your referral code and they will only assist you to win. 

5. Prizes: The Winner(s) of the Campaign (the “Winner”) will receive the following Prizes:

Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Shine Bathroom Technologies Inc.. No cash or other prize substitution shall be permitted except at Shine Bathroom Technologies Inc.’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Shine Bathroom Technologies Inc. to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

6. Odds: The odds of winning depend on the number of eligible entries received. The more people you refer to join the campaign, the more chances you have to win by ranking higher up in the leaderboard.

7. Winner Selection and Notification: Winner(s) will be resulted in real-time by the time that the contest will be finished, under the supervision of Shine Bathroom Technologies Inc.. Winner will be notified by by email within five (5) days following appointment of Winner(s). Shine Bathroom Technologies Inc. shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT Shine Bathroom Technologies Inc.‘S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Optional verbiage for Contests: By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Shine Bathroom Technologies Inc.. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Shine Bathroom Technologies Inc. from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Shine Bathroom Technologies Inc. may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Terms & Conditions: Shine Bathroom Technologies Inc. reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond Shine Bathroom Technologies Inc.’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Shine Bathroom Technologies Inc. may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Shine Bathroom Technologies Inc.. Shine Bathroom Technologies Inc. reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. Shine Bathroom Technologies Inc. has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Limitation of Liability: By entering, You agree to release and hold harmless Shine Bathroom Technologies Inc. and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

11. Disputes: THIS Campaign IS GOVERNED BY THE LAWS OF California, United States, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Santa Barbara California having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.
